However, since then, Jason’s Internet addiction has been temporarily suppressed under the strict control of the school.

  After studying in a new school for two years, Jason was finally admitted to a good local university. After going to college, Jason’s playing games was no longer out of control. Jason told the reporter of China Youth Daily and Zhongqing Online that his studies in college were not affected by playing games. However, Jason’s father said that his son spent almost every day in the Internet cafe since his sophomore year, and finally he graduated from college, just muddling through.

  Jason also participated in the national college students’ e-sports competition and won an award when he was in college, but it was this experience that made him understand that an e-sports player is far from playing games, and needs strict and boring training. When entertainment turns into work, few people can actually persist.

  Therefore, when talking about quitting his job one year after graduating from college and starting to focus on online games completely, Jason’s answer to the reporter’s question of why he didn’t take part in e-sports competition again was that he could never aim at becoming an e-sports player, because it was too difficult to take that road.

  In the summer of 2016, I graduated from Jason University, and then entered a local company with good conditions in all aspects step by step. However, work can’t bring people a sense of excitement and accomplishment as quickly as games. After gradually discovering the dullness of work, Jason began to devote more energy to online games, from going to Internet cafes to play games after work at the beginning, to taking time off to play games, and then to absenteeism to play games. The unit leader talked to him again and again, and talked to his parents, but they couldn’t make him change his mind.

  Less than a year after graduating from college, Jason voluntarily gave up his first job in life, and then looked for several jobs, but all of them could not be maintained within a few days. Jason’s father knows very well that his son’s mind is completely on online games. Where can real life bring him excitement and excitement like the online world?

  In the following year, Jason lived a black-and-white life. Jason’s father was annoyed but helplessly watched his son spend every night in the Internet cafe. He went home to eat and sleep early in the morning, slept until three or four o’clock in the afternoon, and then ate something to go to the Internet cafe. Later, Jason stopped going to Internet cafes, so he shut himself in his room all day. He said that he didn’t always play games, and he spent a lot of time browsing and chatting with people online, but he just couldn’t leave the computer.

  Jason’s father found that his son, who was cheerful and talkative, had become listless and could not even speak fluently after blocking himself in the online world for nearly a year.

  Jason’s father felt that his son was "dying" mentally, and he had to find a way to save his son.

  In May, 2018, Jason’s father made up an excuse to cheat Jason to Beijing and live directly in the psychological growth base for teenagers in China. Jason found that he came here to give himself up Internet addiction, and then he rebelled by means of hunger strike, leading other children to "riot" and running away. Jason’s father was determined not to compromise with his son.

  After various means of resistance failed, Jason finally understood his father’s determination and began to receive treatment.

  The treatment process is full of challenges. After the son started Morita therapy (the treated person is alone in a room with only one bed in the room, which ensures the basic living conditions of the treated person, but there are no social activities, reading, entertainment and other activities to force the treated person to think, examine and recognize himself), Jason’s father did not expect that other children only need Morita therapy for 30 to 40 days, but his son actually did it for 70 days.

  The harm of Internet addiction to teenagers will become increasingly prominent.

  In the past 16 years, China Youth Psychological Growth Base has treated more than 10,000 teenagers with Internet addiction. Tao Ran, director of China Youth Psychological Growth Base and director of Addiction Medicine Center of Beijing Military Region General Hospital, told China Youth Daily and Zhongqing Online reporter, "A large number of examples show that even if teenagers with Internet addiction complete the treatment of quitting Internet addiction, the physical and mental harm that Internet addiction brings to children will be lifelong."

According to the recommended standards of international medicine, teenagers over 8 years old should play video games for less than one hour every day, but teenagers with internet addiction generally play video games for more than three or four hours every day, which can easily cause serious damage to their vision.

  Internet addiction teenagers have been sitting quietly for a long time facing computers and mobile phones, and lack of sports. Tao Ran said sadly that these children were supposed to be the most energetic, sunny and energetic, but because they were addicted to games, they delayed the best opportunity for physical development.

  Secondly, the permanent damage caused by internet addiction to children’s brains directly affects children’s intellectual development, mental state and social life ability.

  According to Tao Ran, related research shows that long-term addiction to video games will lead to frontal lobe ischemia of teenagers’ brains and affect their development. In addition to affecting children’s intellectual development, the most important thing is the harm caused to children’s psychological development.

  Tao Ran said that there is now a metaphor for Internet addiction teenagers as "machine brain". This means that teenagers with internet addiction generally have no normal emotions and feelings, and like a robot, they treat people and things around them with a cold attitude. They only have emotions when they are addicted to games, but in real life, they are not interested in everything.

  However, human beings are gregarious animals, and the development of human society is based on gregarious and social interaction. Only normal communication between people can achieve healthy psychological development. If a teenager or a minor faces a computer or a mobile phone every day and looks for life in the game, his world outlook, values and outlook on life are not mature, and his brain is still in the developing stage. In this state of life, these internet addiction teenagers often have no human feelings, do not understand interpersonal relationships, leave school, and then leave society when they are older. Their life has become virtual, that is, to face life in the way of games, and then to moralize and legalize.

  In Tao Ran’s view, the mental development of teenagers with Internet addiction has been seriously affected because they have been addicted to online games for a long time, and their mental age is often 4 to 5 years younger than their actual age. The immature psychology of teenagers with internet addiction, coupled with the misleading that either you hit me or I hit you and kill people in the game world, leads them to tend to solve problems by violence.

  According to Tao Ran’s investigation, about 86% teenagers with Internet addiction have used violence against their relatives.

  When parents and family members stop themselves from playing games, teenagers with internet addiction often beat and scold their parents and family members instead of admitting their mistakes. What’s more, if their requirements for playing games are not met, teenagers with Internet addiction may even kill their parents. On December 31 last year, such a tragedy happened in Hengnan County, Hengyang City, Hunan Province. A 13-year-old junior high school student killed his parents with a hammer because he couldn’t ask his parents for the internet fee. Such vicious cases related to Internet addiction have been common in the past few years.

  The China Youth Psychological Growth Base located in Beijing has not received many teenagers with Internet addiction from Beijing, accounting for only about 5%. This is another typical phenomenon that Internet addiction harms Chinese teenagers, that is, the bigger the city, the less serious the problem is, the situation in small and medium-sized cities is worse than that in big cities, and the problem of teenagers with Internet addiction in rural areas is the most serious.

  Tao Ran said that mainly because of the families in big cities, children get more perfect family education, and parents’ educational concepts are more scientific, so they will avoid and interfere with children’s excessive contact with video games as soon as possible. In addition, children in big cities have too many things to play and learn, and they don’t have so much time and space to indulge in online games.

  In contrast, children in rural areas are obviously lacking in family education, and some rural children may also be left behind. Grandparents are responsible for taking care of their children, and often have no more energy to restrain their children from surfing the Internet and playing mobile phones.

  Don’t think that the problem of internet addiction teenagers in rural areas is far away from those of us who live in big cities. Tao Ran said anxiously that in the future, after these left-behind children and internet addiction teenagers in rural areas enter the city, their psychological and personality problems caused by online games for a long time really need the attention of the whole society.   Behind the name recognition of e-sports is the growing problem of teenagers’ internet addiction.

  For video games to expand publicity in the name of e-sports, Tao Ran’s suggestion is that e-sports must be over the age of 21 or 22 (equivalent to graduating from college) to participate. This avoids the participation of teenagers and young people whose brains are developing and whose "three views" are being established. E-sports can be played, but it must be played by adults over the age of 21 or 22. Tao Ran found that 80% of teenagers with Internet addiction wanted to become e-sports players, which actually became an excuse for them to indulge in online games.

  As far as schools are concerned, schools and teachers should publicize the dangers of excessive use of computers, electronic products and addiction to games just as they do anti-drugs.   In the past two years, there has been more and more publicity about e-sports in public opinion. Tao Ran believes that this is because some of our game manufacturers actually hold the tools of public opinion, which are the media while developing games. If the enterprises selling tobacco have mastered the media tools, can it still say that smoking is harmful to health? Therefore, game manufacturers will use their own media platforms to talk about the infringement of games on children, and say that games need to be controlled? An enterprise that grasps public opinion will certainly sing a song of praise for what it has developed.

  Then, as a game manufacturer, at the same time, it holds a powerful tool of public opinion. Is this inappropriate? Should we have a system similar to the Anti-Monopoly Law, forcibly divest the media platforms of these companies, or split enterprises?

  E-sports entering the Asian Games and possibly entering the Olympic Games is a hot topic of public opinion in recent two years, and it is also a powerful starting point for e-sports to carry out image innovation. However, the so-called competition of electronic games itself is still controversial.

1. Does the live broadcast of NBA sports events constitute the object of copyright protection?

In recent years, whether it is Qiong Yao v. Zheng Yu or Jin Yong v. Jiangnan, the controversy behind it shows that copyright is getting more and more attention and protection. Universal copyright convention and Berne Convention both express the need to protect human intelligence and creative achievements. As a participating country of the Convention, China has also made protective provisions on copyright.

According to the relevant provisions of China’s Copyright Law, the copyright owner enjoys the copyright, and no individual or unit may infringe upon the copyright of others. Article 3 stipulates that the objects protected by China’s Copyright Law include (1) written works; (2) Oral works; (3) Works of music, drama, folk art, dance and acrobatics; (4) Works of art and architecture; (5) Photographic works; (6) cinematographic works and works created by methods similar to cinematography; (seven) engineering design drawings, product design drawings, maps, schematic drawings and other graphic works and model works; (8) Computer software, etc.

As a kind of live broadcast of sports events, the live broadcast of NBA sports events mainly focuses on shooting and broadcasting the live events of sports events. Can this kind of live broadcast of sports events constitute a film work or a work created by a method similar to filming, and then be protected by copyright?

According to the Regulations for the Implementation of the Copyright Law, the works protected by the Copyright Law refer to the intellectual achievements that are original and can be reproduced in some tangible form in the fields of literature, art and science. Therefore, to analyze whether the live broadcast of NBA matches belongs to the object of copyright protection, it mainly depends on whether the live broadcast is original and whether it can be copied in some tangible form.

1.1 How to identify originality?

International copyright treaties, such as Berne Convention and Copyright Treaty of the World Intellectual Property Organization, have not specifically recognized originality. Because of different legal systems, different countries have different understandings of originality.

1.1.1 "forehead sweat standard" and "floor standard" in common law system.

The anglo-American legal system first made it clear in the Bleistein case in 1903 that the work needed to be completed by the author independently. In later practice, Britain and the United States took "whether to work or not" as one of the factors to identify originality in order to protect the author’s labor when creating works, which is also what we call "forehead sweat standard".

In the Anglo-American legal system at this time, the court decided whether the work was original or not mainly by considering whether the work was independently completed by the author and whether the corresponding labor was invested. At this time, originality did not pay too much attention to the "creativity" of the work.

Subsequently, in the Feist phone book case in 1991, the court began to emphasize the "creativity" of the work, that is, if the author simply put in labor, he could not determine that his work was original, but also needed a certain degree of creativity. However, Britain and the United States did not clearly define the "more or less" of creativity, but adopted the "floor standard", that is, creativity can be recognized as long as there is a small amount of creativity.

We can see from it that,British and American countries identify originality mainly on the basis of "independence"-independent labor completion and "creation"-creativity.

1.1.2 High standards of civil law countries

Different from the lower standard "floor standard" adopted by Britain and the United States, the countries of civil law system are more strict in determining originality. Taking Germany as an example, it believes that originality requires the production of works to be creative labor input, and the labor input at this time is not just a simple labor input when the forehead sweats, but requires certain creativity. In other words,The originality at this time requires that the work can reflect the author’s intelligence and thoughts and feelings, and the expression of these thoughts and feelings needs to reach the level of reflecting the author’s personality..

At the same time, creativity is not as low as the "floor standard" required by Britain and the United States, but requires a high degree of creativity. This is mainly because in civil law countries, works are regarded as the children of the author, and works are the extension of the author’s personality spirit and the embodiment of the author’s thoughts and feelings. It regards copyright as a personal right, so it adopts this high standard to protect the author’s rights.

1.1.3 China’s originality standard

There is no clear legal provision on originality in legislation in China, and domestic scholars have different opinions on it. Professor Cui Guobin believes that originality requires independent creation and the creative result has the lowest degree of creativity; Professor Li Mingde believes that the author has invested in intellectual labor and has the lowest degree of creativity when creating works; Professor Wang Qian believes that originality requires that "the work product should be independently completed by the author" and "the creation of the work product should have a certain degree of creativity" …

Analysis of the views of scholars, it is not difficult to find that their recognition of originality has one thing in common."the lowest degree of creativity"This shows that our country has not adopted the high standard of originality similar to that of civil law countries, but only requires the lowest degree of creativity, which is also reflected in judicial practice.

1.2 Is the live broadcast of NBA events original?

Combined with the above introduction to the identification of originality, is it original for the live broadcast of sports events? In this regard, everyone has different views. Some people think that the focus of live broadcast of sports events lies in sports events, which are interpreted by athletes, and the filmmakers only record and broadcast according to the needs of watching the games, which should only constitute video products. However, some people think that recording sports events also reflects the intelligence and thoughts of the recorder and has certain originality.

Speaking of this, we have to mention "the first case of China’s game broadcast", that is, the five-year-long "Sina v. Fenghuang. com infringement case". After the first trial, second trial and retrial, the Beijing Higher People’s Court recently made a retrial judgment, overturning the second trial judgment, and found that the involvement of Phoenix Net and its operator Beijing Tianying Kyushu Network Technology Company infringed the copyright of Sina Internet Information Service Co., Ltd.It is believed that the live broadcast of sports events is original and constitutes a film work, which can be protected by copyright.

This case can be described as full of twists and turns. In the first instance, the court held that "the selection and arrangement of the recording shots of the competition to form a new picture for viewing is a creative labor, and the creativity will produce different picture effects due to different choices and different productions, which further reflects its creativity." That is to say, in the judgment of the first instance, the court found that the picture formed by the recording of the competition constituted the requirement of the originality of the work in China’s copyright law and belonged to the works protected by the copyright law.

However, in the second trial, the court classified this kind of film production as documentary film production, and determined it according to the original identification standard of documentary film production, so it was considered that it was not a film production, but a video production.

Subsequently, Sina did not recognize the judgment and filed a retrial with the Beijing Higher People’s Court. The Beijing Higher People’s Court held that the lowest level of creativity was adopted in the determination of originality in China. In other words, China only discussed the "existence" of creativity, not the "quantity" of creativity. The recording process of sports events reflected the choice of shooting angle, lens switching, shooting scenes and objects, selection, editing, arrangement and shooting pictures. In the final judgment of the Beijing Higher People’s Court, the court found that the live broadcast of the event involved constituted "a work created in a way similar to making a film".

From the above cases, we can see that,The live broadcast of sports events is original because it embodies the photographer’s unique ideas in the filming process.In the process of live broadcast of NBA events, Tencent Sports will not only film itself, but also explain it outside the picture, which is original in both the filming idea and the presentation of the explanation. 1.3 Does the live broadcast of the event belong to a certain medium?

We know that the live broadcast of sports events needs to be filmed on a certain medium if it wants to constitute a film work. In the case of Sina v. Fenghuang. com, the court of second instance found that Sina’s live broadcast of the Super League did not fix the filming on a certain medium, which exceeded the definition of film works in Article 4 of the Regulations for the Implementation of Copyright Law.This article stipulates that cinematographic works and works created by methods similar to cinematography refer to works that are filmed on a certain medium and consist of a series of pictures with or without sound, and are projected by means of appropriate devices or disseminated by other means.However, the regulation does not regard fixation or stable fixation as the constitutive requirements for determining whether a work is a work, so "shooting on a certain medium" should be interpreted broadly and leniently, so it is also affirmed in the judicial judgment that the live broadcast of the game belongs to shooting on a certain medium.

To sum up, if the live broadcast of sports events can reflect the individual choice and arrangement of the filmmakers, rather than just mechanical recording, it will be original, and the broad media interpretation also shows that the live broadcast of sports events meets the requirements of "shooting on a certain medium". Therefore, if Tencent Sports Live NBA matches meet the above requirements, it can also be the object of copyright protection. In fact, as early as before this judicial decision, the live broadcast of sports events was difficult to be recognized as a film work, and the filmmakers were easily infringed by their peers. In the face of such infringement, how did they do it?

Second, the infringement that may be involved in the live broadcast of sports events

2.1 may constitute unfair competition

Among many litigation disputes involved in live broadcast of sports events, the most common one is unfair competition dispute, which is mainly due to the fact that in the previous judicial practice, the products formed by live broadcast of sports events are difficult to be recognized as works protected by copyright law. Therefore, under normal circumstances, many infringers will choose to file a lawsuit on the grounds that the infringer violated the Anti-Unfair Competition Law. For example, in the case of CCTV International v. "I love chatting", the court decided that I love chatting about the company’s behavior of "broadcasting" CCTV related channels on its "tv powder" client.Although it does not constitute a broadcast act as stipulated in Article 45 of the Copyright Law, it obviously violates the market principle of fair competition, undermines the market competition mechanism, violates the principle of good faith and recognized business ethics, and constitutes unfair competition.

2.2 may constitute a violation of the right to disseminate information on the Internet.

Through the previous judicial practice, we can see that it is difficult to identify the products produced by the live broadcast of such sports events as movies or works created by similar methods. During the filming of 2014 fifa world cup TV program, Stormwind broadcasted the live broadcast of the events produced by CCTV, which is similar to the case of Sina v. Phoenix. In the second instance, the court did not identify the live broadcast of the events produced by CCTV International as movies, because according to the relevant provisions of China’s copyright law, if it cannot be identified as movies, it should be regarded as video products. Therefore, the broadcast behavior of Stormwind Technology also constitutes an infringement on the information network communication right of CCTV International.

Of course, in the latest retrial judgment of "CCTV International v. Stormwind Technology" on October 9, 2020, we found that, like Sina v. Phoenix.com, the Beijing Higher People’s Court once again determined that CCTV International’s live sports events constitute film works, which also gave new guidance to courts at all levels in the future in judging similar cases, that is, live sports events can be recognized as film works if they meet the relevant recognition conditions.
